What One Court Gives, Another Takes Away
On August 4, 2010, a California district court overturned Proposition 8, effectively allowing same-sex marriages in California. This decision was expected to be appealed and on August 12, 2010, the district court judge ruled that same-sex marriages should be allowed pending appeal.
Well, what one court gives, another takes away. On August 16, 2010, the Ninth Circuit Court of Appeals granted a motion for a stay, effectively reinstating the ban on same-sex marriages pending appeal. This means that while the case is being reviewed by the Ninth Circuit, same-sex marriages cannot move forward. The appeal proceedings are currently scheduled to take place the week of December 6 in San Francisco. The wheels of justice move slowly.
